A short-term vacation rental contract and differs in Texas law from that of a residential lease. The property manager/owner or representative has the right to enter the property with reasonable notice for the protection, inspection, or maintenance of the property, and/or enforcement of this agreement up to but not limited to full eviction and forfeiture of all amounts paid including damage deposit.  

Payment Terms

We accept payment by electronic bank transfer, credit card or Apple Pay.  A non-refundable reservation deposit is required to secure this reservation.  The balance is due in full at least 30 days prior to check-in. 

If the full balance has not been paid after 30 days prior to check-in, the reservation will be canceled just as if you canceled it, and standard cancellation terms will apply, including forfeiture of the reservation deposit.

Security/Damage Deposit

A security deposit or a card on file is required to hold your vacation rental reservation. We must receive a valid credit card or a payment of the security deposit at time of booking. Upon receiving the reservation deposit, card on file and/or security deposit, and a signed, dated copy of the Rental Agreement, your reservation will be confirmed and a rental confirmation will be emailed to you.

Upon your arrival, your security deposit converts to a damage deposit. The damage deposit will be returned to you within 3 to 7 business days provided that the following provisions are met:

  • No damage is done to the property or its furnishings
  • No items are missing from the property.
  • No items have been left on the property (including excess trash) that require disposal
  • There are no violations of this agreement.

Credit Card Verification

At the time of booking, if a credit or debit card is used, you agree to provide the host a photo showing a valid ID of the cardholder and a picture of the payment card to verify that this transaction is properly authorized, just as you would show a merchant during an in-person transaction. 

Terms and Conditions

VIOLATION OF ANY OF THE FOLLOWING TERMS AND CONDITIONS WILL RESULT IN EVICTION AND ALL AMOUNTS PAID INCLUDING THE FULL DAMAGE DEPOSIT WILL BE FORFEITED OR THE CARD ON FILE WILL BE CHARGED ADDITIONAL FEES. 

You must be 25 years of age to rent this property. By signing this agreement, you acknowledge that you are 25 years of age or older. Proof of age with valid ID is required at the time that the property is booked. Any falsification of age will result in immediate eviction and all amounts paid, including damage deposit, will be forfeited. 

By signing this agreement, you acknowledge that you are responsible for the conduct of all persons you invite or allow to remain on or in the property during the dates of this reservation. Your reservation is confirmed for only the number of guests listed on your confirmation and prior to check-in, you will be required to complete a Guest Registration Form listing the names and ages of all persons who will be on the premises. The property has a guest maximum occupancy of 30 people, day or night including the deck, interior, exterior, grounds, driveways, and beach area.  Exceeding this occupancy limit or falsifying occupancy is strictly prohibited. Violation of the Occupancy Limit will result in immediate eviction and all amounts paid, including damage deposit, will be forfeited. 

House parties, social events, and/or ANY activity where guests not listed on the Guest Registration or exceeding the occupancy limit are invited (including weddings, dinners, family reunions, and prom parties) are only allowable if previously approved in writing by the host, and only so long as all persons on the property strictly follow the terms and conditions. Any violation will result in immediate eviction and all amounts paid, including damage deposit, will be forfeited. 

Subleasing the property in any form is strictly prohibited. 

As the responsible party signing this agreement, you must personally be in residence during the entire stay and when requested by law enforcement or other authority you must provide a copy of this signed agreement.  By signing this agreement, you acknowledge that you are responsible for the conduct of all persons you invite or allow to remain on the property during the time of your reservation. 

Any guest(s) engaging in or being arrested for any illegal activity, including the possession of illegal substances, is strictly prohibited anywhere in or on the property. The Guest(s) will be subject to immediate eviction and all amounts paid, including damage deposit, will be forfeited.  

You must comply with all city noise ordinances.  No loud noise is allowed after 11:00 pm or before 9:00 am. 

No pets of any kind are allowed on the property.   

There are designated parking areas for each house. Parking is not allowed on the street in Surfside, or in front of the neighbor’s houses (or in their driveways).  Parking in other than a designated place will result in the towing of your vehicle(s). 

Our beach house rentals are intentionally barefoot-friendly environments for our amazing guests (many of whom are small children), so we have a strict policy of not allowing any glass containers outside, on the beach, underneath the house, or on the deck.  Glassware, bottles, etc are strictly prohibited. 

Open flame of any kind underneath the house, on the deck, or inside the house is prohibited.  It is an extreme fire hazard to have flames anywhere near an elevated house.  Candles and small, controlled bonfires are allowed on the beach (on the water side of the dunes), but are not allowed within 30 feet of the structure.  No BBQ grilling is allowed on or near enclosed decks.  If the charcoal grill is used, it must be pulled out far away from the house.  Fireworks are strictly prohibited, both on private and public property.  

Do not open any windows unless there is an emergency. Opening causes damage to the windows and makes them prone to leaking.  Open windows allow a large amount of moisture to quickly blow into the house which requires extensive cleaning and moisture damage. for which an extra cleaning fee will be assessed. 

Only registered overnight guests are allowed on the property during the hours of 11pm to 7am hours. 

Events on the Beach

For any events on the beach, you acknowledge that the actual beachfront in Texas is accessible by the public as well as our neighbors, and you will need to stake out the area that you need well in advance the day of your event.  All events must be conducted respectfully of the neighbors.  Driving is not allowed on the section of beach in front of the property, however, your event may not completely block pedestrian traffic on the beach. 

If your event includes a catered dinner / reception and/or dancing, this should be located on the ground floor (on the beach or underneath the house), and not in the house itself or on the elevated deck, as the house and deck are on stilts and not built to support a large group of people dancing. 

The areas beneath the neighbors’ houses are private property, and guests are not allowed to walk underneath the neighbors’ houses. 

Housekeeping and Other Matters

When you arrive, the property will be clean and the beds made with fresh linens. We have included the following supplies to accommodate the appropriate number of guests:

  • Bath towels, hand towels, wash cloths.  Beach towels are not provided, please do not take bath towels to the beach. 
  • Initial supply of dishwashing soap, hand soap, paper towels and toilet paper   

This is a non-smoking and non-vaping property, both inside and outside.  If smoking is detected inside the property, the full damage deposit will be forfeited and an extra cleaning fee will be assessed. 

Lock all doors when you leave the house to keep your personal items safe.  Property manager and property owner are not liable or responsible for personal items left behind, lost or stolen.

The BBQ grill, hot tub, and the deck area are intended for the enjoyment of adult guests. Keep children away from these areas unless there is constant adult supervision. The beach and open-water areas present certain dangers. Renter/Guests must respect nature and take care to guard themselves and their guests as appropriate. Owner is not responsible for accidents and/or injuries. 

Check-in time is 5 p.m. CST and is completed through a completely private self check-in process.  Please respect this time as in many cases the property has been rented the night before and we require time to prepare for your stay. 

Checkout

Check out time is 10 a.m. CST.  Prior to checkout, 

  • Start the dishwasher and put away dishes if time permits.
  • Place used towels in the two large laundry baskets. One is located upstairs and one is downstairs.
  • Please remove all of your food and drinks from the refrigerator and cabinets.
  • Please take out the trash and place it in the 3 large garbage bins below the house.
  • Check for any personal items (chargers, phones, iPads, personal pillows and blankets)
  • Please turn off all lights and lock the front door when you leave.

Guests who are still on the property 30 minutes after checkout are subject to a $200 late checkout fee. Guests who are still on the property 90 minutes after checkout are subject to paying an additional night’s rent or $500, whichever is greater.

Cancellation Policy

If you cancel more than 30 days in before check-in and have already paid for the reservation in full, 50% of the total reservation fee will be returned.  If you cancel more than 7 days before check-in, only the Cleaning Fee will be returned.  Cancellations within 7 days of check-in will not receive any refund. No refunds will be granted for cancellations due to weather or any other circumstances unless there is a mandatory evacuation of the island.  

Force Majeure. There may be circumstances beyond our control and contemplation, in which the property might not be available for your booking. Examples of these include (but are not limited to) extended power or other utility outage (lasting more than one day), severe weather, and destruction of or severe damage to the property. In the event of Force Majeure, we will do our best to make alternative arrangements for you where possible. If we cannot, or if the alternative arrangements are not acceptable to you, then we will refund a prorated amount reflective of the number of days affected during your reservation. This will be the full extent of our liability to you in such circumstances, and we will not be responsible for any other costs connected with any such cancellation,
